By accessing or using KinderTime (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and KinderTime (“Company,” “we,” “us,” or “our”).
The Service is intended solely for use by adults who are at least 18 years of age and are legal residents of the United States. By using the Service, you represent and warrant that you meet these eligibility requirements. The Service is not available to residents outside of the United States.
The Service is designed to be used by parents and legal guardians to coordinate activities for children. Children under the age of 18 are not permitted to create accounts or directly use the Service. Any information about children entered into the Service must be done so by a parent or legal guardian.
To access the Service, you must create an account. You agree to: (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; (c) maintain the security of your credentials and accept responsibility for all activity under your account; and (d) notify us immediately of any unauthorized access or security breach.
We reserve the right to disable your account at any time if we believe you have violated these Terms.
The Service facilitates the scheduling of activities involving minors. In compliance with the Children's Online Privacy Protection Act (“COPPA”), we do not knowingly collect personal information directly from children under the age of 13. All information about children (including first names, ages, and availability) is entered and controlled exclusively by parents or legal guardians.
By entering information about a child into the Service, you represent and warrant that you are the parent or legal guardian of that child and that you consent to the collection and use of that information as described in our Privacy Policy.

The Service allows users to send messages in connection with scheduled kindertimes. You retain ownership of content you submit, but grant us a limited, non-exclusive, royalty-free license to store and transmit that content solely for the purpose of providing the Service.
You are solely responsible for the content of your messages. We reserve the right, but have no obligation, to monitor, edit, or remove content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
KinderTime is a scheduling tool only. We do not conduct background checks on users, verify identities, or assume any responsibility for the safety of in-person meetings arranged through the Service. Users are solely responsible for exercising appropriate judgment and taking necessary safety precautions.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 8, 9, 11, and 12.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the Company is incorporated, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
